Seminar with Eliška Mainclová: Public Guardianship in the Czech Republic: Expectations v. Reality
Eliška Mainclová examines the role of public authority in safeguarding the rights of older people and persons with disabilities in institutional care, with a particular focus on public and administrative law. Her research brings this perspective into dialogue with more established civil law and human rights approaches, highlighting how public institutions, administrative structures, and oversight mechanisms shape the practical protection of individual rights. Eliška explores the Czech model of public guardianship, including the role of municipalities, fragmented legislation, the absence of binding quality standards, and tensions with the requirements of Article 12 of the UN Convention on the Rights of Persons with Disabilities. She is particularly interested in a comparative discussion on how different legal systems organize and regulate public guardianship.
