The Legality of Australia´s Under -16 Social Media Ban - Does it Impermissibly Limit Political Communication?

Australia's under-16 social media ban limits political communication by restricting young Australians' ability to participate in online political discourse. The legislation introducing the ban is currently being challenged in the High Court of Australia on several bases, including that it breaches the ‘implied freedom of political communication’ in the Australian Constitution. In this seminar, Maria O’Sullivan – a visiting public law and human rights scholar from Australia - will examine the reasons for introducing the ban and whether it is likely to be constitutionally valid. Specifically, whether the Australian government will be able to demonstrate that the restriction serves the legitimate purpose of protecting children's welfare and is proportionate under the implied freedom of political communication doctrine.

Maria O’Sullivan is an Associate Professor in the Deakin Law School in Melbourne, Australia. She is the author of a number of international and national publications on the subject of human rights, public law and technology. Maria has recently published an edited volume on protest with Professor Azadeh Dastyari: International Law and the Regulation of Protest (Routledge, 2026) and her work on technology and human rights has been cited by a variety of international and national bodies, including the Australian Human Rights Commission and the Meta Oversight Board.

Sue Anne Teo is a thematic expert and researcher on AI and Human Rights at the Raoul Wallenberg Institute of Human Rights and Humanitarian Law (RWI). She was a 2025-2026 Technology and Human Rights Fellow at the Carr-Ryan Center, Harvard Kennedy School. Sue Anne is also the Principal Investigator of a SEK 6 million project funded by the Riksbankens Jubileumsfond on Anthropomorphic AI and Emergent Vulnerabilities.
